📜 Terms of Service

Welcome to TAS DroneXchange (“we”, “our”, “us”). By accessing or using our marketplace to buy, sell, rent drones, docks, accessories, and operator services, you agree to these Terms of Service. Please read them carefully.

1. Eligibility ✅

  • You must be 18 years or older to use TAS DroneXchange.
  • Sellers, renters, and operators must hold any required CASA certifications (e.g., REPL, RPA Operator’s Certificate).
  • Service providers (training schools, drone shows, inspection companies, etc.) must hold relevant licenses, permits, or approvals for their activities.
  • By registering, you confirm the information you provide is accurate and truthful.

2. Marketplace Role 🛒

  • TAS DroneXchange is a platform only. We connect buyers, sellers, renters, and service providers but do not own or directly sell drones, docks, accessories, or services.
  • We do not guarantee the quality, safety, legality, or compliance of items or services listed.
  • Transactions occur directly between marketplace participants.

3. User Accounts 👤

  • You must create an account to buy, sell, rent, or list services.
  • You are responsible for safeguarding your account credentials.
  • Providing false or misleading information may result in suspension or termination.

4. Listings 📦

  • Sellers, renters, and service providers must provide accurate details (model, condition, flight hours, rental terms, training certifications, event details, etc.).
  • Prohibited listings include drones without proper certification, unsafe equipment, illegal payloads, or services that breach CASA or local regulations.
  • TAS DroneXchange may remove any listing that violates laws or these Terms.

5. Payments & Escrow 💳

  • All payments are processed via Stripe Connect.
  • Buyer payments are held in escrow until:
    • The buyer confirms receipt of goods; or
    • The rental period or booked service (training, show, inspection, etc.) has been delivered in agreed condition.
  • Sellers, renters, and service providers receive payouts after escrow release, minus applicable fees.
  • TAS DroneXchange may charge a transaction fee (5–10%) per completed order.

6. Deposits (Rentals & Services) 💰

  • Rentals and certain services (e.g., operator hire, event bookings) may require a security deposit.
  • Deposits are held securely via Stripe and refunded after safe return of the drone, dock, accessory, or successful service delivery.
  • Deductions may apply for damage, late returns, no-shows, or breach of terms.

7. Cancellations & Refunds 🔄

  • Buyers may cancel before shipment/pickup; renters may cancel before the rental start date; service bookings may be cancelled in line with provider terms.
  • Refunds are processed in line with Australian Consumer Law and the seller’s/renter’s/service provider’s stated cancellation policy.
  • TAS DroneXchange is not liable for refunds outside escrow transactions.

8. User Responsibilities 🧑‍✈️

By using TAS DroneXchange, you agree to:

  • Comply with CASA regulations and all applicable laws.
  • Operate drones only where legally permitted.
  • Maintain insurance if required (recommended for rentals, enterprise use, and professional services).
  • Return rentals on time and in the same condition received.
  • For services: deliver them as described, safely and legally.

9. Disputes ⚖️

  • Disputes between buyers, sellers, renters, and service providers should first be resolved directly.
  • If unresolved, TAS DroneXchange may assist in mediation but is not a guarantor of outcomes.
  • Funds in escrow may be withheld until disputes are settled.

10. Prohibited Conduct 🚫

You may not:

  • Use TAS DroneXchange for illegal activities.
  • Circumvent the platform to avoid fees.
  • Upload false, misleading, or harmful content.
  • Attempt to hack, disrupt, or misuse the platform.

11. Liability & Indemnity ⚠️

  • TAS DroneXchange provides the platform “as is” without warranties.
  • We are not liable for accidents, damages, loss, or misuse of drones, docks, accessories, or services obtained through the marketplace.
  • Users agree to indemnify TAS DroneXchange against claims arising from their use of the platform.

12. Data & Privacy 🔐

  • Personal data is handled according to our Privacy Policy.
  • By using the marketplace, you consent to data processing necessary for verification, payments, and compliance.

13. Termination ⛔

TAS DroneXchange may suspend or terminate accounts that violate these Terms, CASA regulations, or applicable law.

14. Governing Law 🇦🇺

  • These Terms are governed by the laws of Australia.
  • Any disputes will be subject to the jurisdiction of courts in Queensland, Australia (or as otherwise required by law).

15. Changes to Terms 📝

We may update these Terms from time to time. Continued use of TAS DroneXchange after updates constitutes acceptance of the new Terms.
